01Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and EhsanLab ("Company", "we", "us", or "our"), concerning your access to and use of the EhsanLab platform, website, software tools, and cloud infrastructure services (collectively, the "Service").
By accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by all of these Terms, including our Privacy Policy and Service Level Agreements incorporated herein by reference. If you do not agree with all of these Terms, you are expressly prohibited from using the Service and must discontinue use immediately.
02Service Description
EhsanLab provides an enterprise-grade cloud governance, compliance validation, and continuous posture monitoring platform. The Service integrates with your cloud service providers to catalog resources, evaluate security settings against compliance frameworks, and automate remediation workflows.
We reserve the right to modify, upgrade, suspend, or temporarily discontinue any aspect of our Service at any time, with or without notice, to maintain operational integrity, implement security patches, or deploy new functionality.
03User Accounts & Access
To utilize EhsanLab, you must register for an enterprise account. You agree to provide accurate, current, and complete registration data. You are solely responsible for maintaining the confidentiality of your account credentials, API keys, and multi-factor authentication devices.
You agree to notify EhsanLab support immediately at [email protected] of any unauthorized use of your credentials or any other breach of system security. We cannot and will not be liable for any losses caused by any unauthorized use of your account.
04Permitted Use
You are granted a non-exclusive, non-transferable, revocable license to access and use the Service strictly in accordance with these Terms. You shall not use the Service for any purpose that is unlawful, prohibited, or disrupts the operational capabilities of EhsanLab.
Prohibited actions include: attempting to reverse engineer EhsanLab source code, utilizing automated bots to scrape analytics data, initiating Denial of Service (DoS) attacks, or bypassing EhsanLab security controls to access other client tenants.
05Intellectual Property
Unless otherwise indicated, the Service, including all source code, databases, operational telemetry algorithms, website designs, audio, video, text, photographs, and graphics, and the trademarks, service marks, and logos contained therein are owned or controlled by us or licensed to EhsanLab.
Nothing in these Terms grants you a license to EhsanLab's proprietary technology or intellectual property rights. All rights not expressly granted to you are reserved by us.
06Confidentiality
Each party agrees to protect the other party's Confidential Information with the same degree of care it uses to protect its own similar proprietary information, but in no event less than a reasonable standard of care.
Confidential Information does not include information that: is or becomes publicly known through no act or omission of the receiving party; was already in the lawful possession of the receiving party; or is independently developed without reference to the disclosing party's Confidential Information.
07Data Protection
We treat your data security with extreme priority. Our practices are governed strictly by our Data Processing Addendum (DPA) and Privacy Policy. EhsanLab maintains SOC 2 Type II attestation, ISO 27001 certification, and strictly complies with GDPR and CCPA requirements regarding customer data transmission.
By using EhsanLab, you consent to our collection, aggregation, and use of anonymized system metadata and infrastructure telemetry to optimize machine learning remediation engines and benchmarking services.
08Service Availability & SLA
EhsanLab guarantees a 99.9% service uptime commitment during any calendar month, excluding scheduled maintenance windows announced at least 48 hours in advance. Service credits for missed SLA targets are detailed in our enterprise Service Level Agreement.
We employ active-active replication across multiple geographic availability zones to guarantee continuous system availability and prevent data loss during underlying infrastructure disruptions.
09Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall EhsanLab, its directors, employees, or partners be liable for any indirect, incidental, special, exemplary, or consequential damages, including loss of profits, data, use, goodwill, or other intangible losses.
In no event shall EhsanLab's aggregate liability for all claims arising out of or related to the use of the Service exceed the total amount paid by you to EhsanLab during the twelve (12) month period immediately preceding the event giving rise to liability.
10Indemnification
You agree to defend, indemnify, and hold EhsanLab, its subsidiaries, affiliates, officers, and agents harmless from and against any loss, damage, liability, claim, or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your violation of these Terms, breach of security covenants, or infringement of third-party IP rights.
11Term & Termination
These Terms shall remain in full force and effect while you use the Service. We reserve the right, in our sole discretion and without notice or liability, to deny access to and use of the Service to any person for any reason, including for breach of any representation, warranty, or covenant contained in these Terms.
Upon termination of your account, your right to use the Service will cease immediately. EhsanLab will retain customer data for 30 days post-termination to facilitate exports, after which all customer data is permanently expunged.
12Governing Law
These Terms and your use of the Service are governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles. You agree that any legal action arising out of these terms shall be filed only in the state or federal courts located in Wilmington, Delaware.
13Dispute Resolution
To expedite resolution and control the cost of any dispute, controversy, or claim related to these Terms, you and EhsanLab agree to first attempt to negotiate any dispute informally for at least thirty (30) days before initiating arbitration or court proceedings.
If a dispute cannot be resolved informally, it shall be settled by binding arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association (AAA) in Delaware.
